The child died after a flight to Almaty. The court found that the airline "E" and the airport were to blame for the tragedy, Tengri Travel reports.
According to the plaintiff, after landing in Almaty, airport staff offered a wheelchair for his seriously ill child, who was in a comatose state and could not sit. The wheelchair did not meet medical requirements.
A private ambulance with a doctor and a parent was not allowed into the airport. As a result, he was transported from the plane to the terminal on an ambulift – a vehicle designed for passengers with limited mobility, but not for seriously ill people.
According to the neurosurgeon's conclusion, the child was in a recumbent state at that time, could not move independently, and passport control should have been carried out through the medical center. But instead, he was taken the usual route – with border control and photography.
The court found that the airline knew about the child's condition but failed to notify the airport that an ambulance was needed. Due to the lack of coordination between services, the child did not receive the necessary assistance.
"During border control, the child, who suffered from keratitis, had his protective bandages forcibly removed from his eyes for photographing. The next day, the child was hospitalized with bilateral pneumothorax and died in February," the report says.
Pneumothorax is a condition in which air enters the pleural cavity, the space between the lung and the chest wall. This causes the lung to partially or completely collapse and stop participating in breathing.
The claim was partially satisfied, and the plaintiff was ordered to pay compensation for moral damages in the amount of 5 million tenge from the air carrier "E". The court's decision has not entered into legal force.
It should be noted that the court's verdict does not indicate the full names of the airport and airline. They are labeled only as "Airline E" and "International Airport".
Earlier, the court satisfied the claim against another Kazakh airline. 12-year-old Zere from Uralsk was returning from the USA with her sister and an escort. In Astana, there was supposed to be a transfer to a FlyArystan flight to Uralsk. Due to overbooking, the girl was not checked in for the flight. The escort boarded the plane, thinking that Zere was already on board. The girl was left alone at the airport and returned home only the next day.
The court found the airline guilty. Zere was awarded 5 million tenge in moral compensation and more than 250 thousand in legal costs.
